The Types Of Personal Injury Damages

Jumping into water off rockWhile the exact amount of a personal injury compensation payout varies on a case-to-case basis (simply due to there being so many variables in every case), there are two main categories that the damage amounts fall into:

Compensatory Damages – this type of result is designed to help place a victim in the same financial, physical and emotional position that they were in before they were injured.

These damages are generally split into two separate areas of compensation:

Monetary Losses:

  • Medical expenses (treatments, rehabilitation etc…)
  • Lost wages
  • Funeral costs
  • Property repair or replacement (generally valued at a fair market price)
  • Associated costs (eg: living with a disability and requiring wheelchair ramps and access to a residence)

In many instances, monetary losses can be relatively easy to determine, based on current market rates.

Non Monetary Losses:

  • Loss of consortium
  • Pain & suffering
  • Mental anguish and stress

On the other hand, non monetary losses can be quite difficult to calculate and as a result, often vary greatly between injury victims.

Punitive Damages – are designed not to provide compensation to the victim, but to punish a defendant for the injuries that they may have inflicted upon another person. These amounts are often created to deter other individuals from repeating the actions of the accused.

In most instances, punitive damages are awarded whenever the actions of the defendant have been beyond what most would consider a reasonably acceptable level of conduct. To avoid excessive punitive damage amounts, many courts will limit the damages to approximately less than ten times the total amount of the compensatory damages.

What Is A Structured Settlement?

MoneyStructured settlements were created to provide an alternative to a lump-sum payment and are set at a specified amount that is spread out over a predetermined period of time.

In instances where a guilty party cannot afford to pay the recipient in one payment, structured settlements allow payments to be made on a monthly or annual basis, spread out over a specific period of time.
