Georgia’s Dram Shop Act
When an individual has been injured or killed in a drunk driving crash, the motorist may not be the only one held liable for the motor vehicle accident. Georgia law allows DUI victims to name drinking establishments as defendants in certain cases. This law is commonly known as the “Dram Shop Act.” The Dram Shop Act holds drinking establishments liable for serving a minor or an adult over the age of 21 that is visibly intoxicated, who later injures or kills another individual because of their inebriation. Additionally, the drinking establishment can only be held liable if they knew the intoxicated individual would soon be driving a motor vehicle after drinking.
