A verdict has been finalized in Texas to award six New York plaintiffs $245 million. The six plaintiffs won a bellwether case in November against Johnson and Johnson and their DePuy Orthopaedics Inc.
The six individuals will receive rewards ranging from $36 million to $48.6 million. The amount covers damages including pain and suffering, past and future medical expenses, and loss of consortium. Johnson and Johnson plans to appeal.
The lawsuit was against DePuy Orthopaedics Inc. and their line of metal-on-metal hip implants line, Pinnacle. These devices were made with a metal ball in a metal cup or socket. Plaintiffs told the jury that these devices were made of unsafe materials, and rushed the hip implants into production, before testing on humans. This caused severe tissue damage and some suffered intense pain, bone erosion, loss of hip movement, and permanent muscle loss. The Pinnacle all metal model being blamed has now been phased out by Johnson and Johnson.
