Many Travis Scott fans were excited to learn about his creation of the Astroworld Festival in Houston, Texas, a namesake for one of his more beloved albums that came out back in 2018. Though many people were excited to buy their tickets to the music festival and carnival experience, none of the patrons could have anticipated how the festival would turn out.
2021 Astroworld Festival
Music festivals attract a large group of a musical artist’s fans and supporters. When there is that much excitement contained into an event, it can often create a dangerous or unstable situation for those in the vicinity. While the crowd’s excitement caused them to rush towards the stage, they broke through the venue’s security barriers and other measures in a way that was unexpected and difficult to contain. During the festival, Scott performed many of his hits, even having fellow rapper, Drake, join him on stage. The whole event was recorded by Apple Music which provided up-close video evidence of the crowd becoming rowdy as the set progressed. Soon enough, the crowd got so out of control that people were getting trampled and many others suffered from injuries.
This is not the first concert that has experienced crowd trampling. Over the decades this has notably happened at a variety of concerts and music festivals. However, fans and online spectators questioned Scott’s refusal to pause or cancel his show to address the increasingly dangerous situation happening in the crowd. Scott claimed he had no idea what was going on even when medical responders arrived to assist those who had been severely injured.
After the incident at the festival, many victims spoke out about their experiences in the crowd and expressed their disappointment in Scott for continuing his performance. Due to the excitement of the festival and the intensity of the crowd, 10 people have been confirmed dead due to crowd trampling. The ages of those who passed range from 9-27 and many families and concert-goers are beginning to seek legal counsel. Around 13 people were hospitalized and over 100 other people sustained minor injuries and traumatic crowd experiences. One concert-goer detailing that they were so desperate to get out of the crowd that they bit someone on the shoulder in order to escape.
Since the severity of the festival came to light, Drake has posted an apology on Instagram which, in part reads, “My heart is broken for the families and friends of those who lost their lives and for anyone who is suffering. I will continue to pray for all of them, and will be of service in any way that I can.” This response came after public outrage for his online silence about the situation and a lawsuit filed against him by a concert-goer who was injured in the stampede.
Travis Scott has received a large amount of criticism after the incident at Astroworld. Not only has he received hateful comments from the media and angry festival-goers, but also from the families of the deceased. Scott posted a video on his Instagram story expressing his devastation for the deceased and assuring the public that he is working with HPD, the Houston fire department, and other parties to get to the bottom of why this happened. He claims that he was unaware of what was going on while he was performing which is why he continued the show. As of now, Scott has been trying to find the families of the deceased and has promised to pay all associated funeral costs.
Apple Music even responded to the situation with a post on Twitter which reads, “Our hearts go out to the victims who tragically lost their lives or were injured at Astroworld and their loved ones. We are devastated.” Scott, Drake, Apple Music, and other parties involved with the creation of Astroworld have been under fire on social media and in the news since the event occurred. Many lawsuits have been filed against these parties in the hopes that they will be held accountable for the horrible situation that took place.
As of right now, over 140 lawsuits have been filed in association with Astroworld. Tony Buzbee, a Houston attorney, is currently assisting a group of 125 injured concert patrons with their 750 million dollar lawsuit against responsible parties associated with the event. Most of the lawsuits present Scott as negligent and contributing to the wrongful death of some of the concert attendees.
Most claims that have been presented so far have cited negligence on behalf of Scott and the other parties who hosted the event. Negligence is defined as carelessness that leads to others becoming injured. There is a standard of ethical care that needs to be provided in order to prevent the injuries and deaths that occurred at Astroworld and many believe that these standards were not met which resulted in mass injuries. Scott has previously gotten in trouble for inciting and promoting dangerous crowd behavior and there is no telling how this will affect him in this situation.
The other types of claims that have been filed are wrongful death claims. Wrongful death is defined as the death of an innocent party due to the negligence of another, in this case, Travis Scott and the festival organizers. In order for this claim to be viable, plaintiffs must prove that the death of their loved ones resulted directly due to the negligence of another and that the death would not have been caused if other actions were to be taken.
While there is no telling how these claims will progress and what will happen, every day more and more claims are being filed in response to the tragic situation that happened at Astroworld.
