Negligence can be defined as failing to behave in a manner using the same level of care that an individual with reason would use given the same set of circumstances. When this type of failure results in injury to someone, a lawsuit may be filed against the responsible party. Frequently, this type of legal suit is aimed at industries like physicians or other medical professionals. However, any entity or individual may be accused of being negligent if their actions or behavior injures someone due to unjustifiable reasoning.
For such a lawsuit to have weight, proof must be given that the accused party committed unreasonable actions. The victim must prove that the injury would not have happened if the negligent party had used “duty of care” and been more aware.
